Threatening a Lawsuit in Your First Refund Email Is a Mistake. Here Is Why.
I threatened a lawsuit in my very first refund email to a company that owed me $300. Big mistake. The company immediately transferred my case to their legal department. Legal departments move slowly. My case sat in legal review for 3 months. When they finally responded, they offered a $100 settlement, citing legal fees. I should have started politely, escalated to a supervisor, and only mentioned legal action as a last resort. Once you threaten a lawsuit, the regular customer service team stops being able to help you. Everything goes through legal, which is slow and adversarial. Save legal threats for your third or fourth email, not your first. And only use them if you are genuinely prepared to follow through.
